Data Centers in Virginia: Lawsuits, Disputes, and Your Rights

Loudoun County branded itself Data Center Alley decades ago, and the industry never left: the county hosts the densest cluster of data centers in the world, with Prince William second and campuses spreading west and south into Fauquier, Culpeper, Louisa, and the Richmond suburbs. Amazon alone has invested tens of billions of dollars in Virginia infrastructure, joined by QTS, Compass, Microsoft, Google, Equinix, Digital Realty, and dozens of others.

The scale is why the conflicts here are sharper than anywhere else. Facilities that were once confined to industrial parks now abut subdivisions and schools. Cooling plants and substations hum around the clock. New transmission lines cross private land to feed the load, and the State Corporation Commission approved a dedicated data center rate class in November 2025 precisely because the industry's grid costs had grown large enough to threaten residential bills.

The complaints that recur across Northern Virginia will sound familiar to anyone living near a campus:

• Noise. The Great Oak subdivision in Prince William County, roughly 300 homes about 600 feet from new Amazon data centers, documented constant mechanical noise beginning in 2022, with readings suggesting exceedances of the county's 60 decibel daytime standard.
• Wells and water. In Louisa County, a homeowner near an Amazon campus under construction reported brown, contaminated well water, dust, and construction noise, and took it to court in 2026.
• Land use shock. The Prince William Digital Gateway would have put more than 22 million square feet of data centers on roughly 2,000 acres beside the Manassas battlefield, and Warrenton approved a 220,000 square foot Amazon facility over broad resident opposition.
• Transmission and takings. Dominion's new lines serving data center load, including routes through Ashburn residential property, have put eminent domain on the table for homeowners who never expected it.

The Digital Gateway litigation. In January 2024, the American Battlefield Trust, Oak Valley residents, and allied plaintiffs sued Prince William County over the December 2023 rezonings for QTS and Compass. In August 2025 the circuit court voided the rezonings because the county's public hearing notice was legally defective, and the Virginia Court of Appeals affirmed in March 2026. Compass and the county dropped out; QTS has appealed to the Supreme Court of Virginia, where the case sits now. It is the most significant neighbor victory in the history of the industry.

Louisa County homeowner v. Amazon. Filed in late July 2026, this suit alleges construction of an Amazon campus fouled the plaintiff's well, coated the property in dust, and subjected the home to constant noise, with claims sounding in nuisance, negligence, and property damage. It is being watched as a template for individual homeowner damage suits statewide.

Citizens for Fauquier County v. Town of Warrenton. Filed in March 2023, this challenge argues the zoning amendment underlying Warrenton's special use permit for an Amazon data center was improperly adopted. After a March 2026 trial and final arguments in June, the case awaits a ruling.

Great Oak noise fight. No lawsuit was ever filed. Residents documented the noise, pressed the county, and Amazon ultimately engineered mitigation that reduced sound roughly 10 decibels. It is the proof that a documented ordinance case can win concessions without a courtroom.

Depending on your situation, Virginia neighbors are using four main paths:

• Nuisance and property damage claims for noise, vibration, dust, and well damage, seeking money damages and mitigation. These are typically taken on contingency.
• Zoning and permit challenges to rezonings and special use permits, which in Virginia have succeeded on procedural and notice defects. Appeal windows are short, in some cases 30 days from the decision.
• Ordinance enforcement through county noise and code complaints, which builds the record for any later claim even when it resolves the problem on its own.
• Compensation fights over transmission takings, where landowners in a Dominion route can contest necessity and valuation with counsel.
