Data Centers in Mississippi: Lawsuits, Disputes, and Your Rights

Two projects define the Mississippi market. In Madison County, north of Jackson, Amazon is investing roughly $10 billion in AWS data center campuses, the kind of hyperscale build-out that transforms local land use, traffic, water demand, and the electric grid for years.

In Southaven, in DeSoto County at the Tennessee line, xAI operates Colossus 2, a companion to its Colossus supercomputer facility in South Memphis. To power it, xAI installed dozens of methane gas turbines, and the question of whether those turbines needed federal air permits before operating is now in front of a federal judge.

For a state with little data center history, that is an extraordinary concentration of AI infrastructure, and it arrived faster than local permitting and oversight practices were built to handle.

The complaints in Mississippi track the two projects:

• Air pollution in DeSoto County. The NAACP's suit alleges 27 gas turbines at Colossus 2 have been operating without the permits the Clean Air Act requires for major pollution sources. Gas turbines emit nitrogen oxides and other pollutants linked to asthma and respiratory harm, and the surrounding communities include neighborhoods already carrying a heavy pollution burden from the Memphis industrial corridor.
• Construction impacts in Madison County. Hyperscale construction means years of heavy truck traffic, dust, and noise. Residents near the AWS sites should document conditions now; in other states, well water problems and property damage claims have grown out of exactly this phase.
• Grid and water questions. Facilities at this scale draw enormous power and cooling resources, and the long-term cost allocation questions that other states are now litigating will reach Mississippi's regulators too.

NAACP v. xAI (pending). On April 14 and 15, 2026, the NAACP, represented by the Southern Environmental Law Center and Earthjustice, filed a citizen suit under the Clean Air Act in the U.S. District Court for the Northern District of Mississippi against xAI and its subsidiary MZX Tech. The complaint targets 27 unpermitted gas turbines at Colossus 2 in Southaven. In May 2026 the plaintiffs moved for a preliminary injunction asking the court to halt unpermitted operation, require best available control technology, and impose daily penalties. The case is pending as of August 2026.

The Mississippi suit is the federal track of a two-state fight: in Memphis, groups challenged the permit issued for turbines at the original Colossus facility, and the local air board dismissed those appeals as moot in December 2025. Madison County (no litigation documented). No lawsuit has been filed over the AWS build-out in Madison County as of August 2026. That is worth stating plainly: the project is enormous and new, and whether disputes emerge will depend in part on how construction impacts are managed and documented.

Mississippi residents affected by a data center have several paths:

• Clean Air Act citizen suits. Federal law lets citizens sue a polluter directly over permit violations after a 60 day notice, which is the NAACP's route.
