Per Niagara County officials, TeraWulf has not paid state or local sales tax on its multi-billion-dollar expansion and had not submitted an application to the Niagara County IDA as of 2026-07. TeraWulf told the county in February 2026 that its operations are exempt under New York's internet data center sales tax exemption, and the county was investigating what it might owe. No dollar figure was stated for the untaxed amount, so the subsidy entry for that exemption names the program without an amount.

Built on the site of the former coal-fired Somerset Generating Station (shut 2019/2020). Address 7725 Lake Rd, Barker, NY, coordinates are a town-level geocode, not a confirmed parcel pin (approximate). TeraWulf's first-quarter 2026 filing describes approximately 500 MW of gross capacity in the near term, with potential expansion to approximately 750 MW subject to additional NYISO approvals; the filing says the campus ground leases cover 162.7 acres, and no whole-site land area is recorded. The AI/HPC business here rests on signed leases rather than speculation: the Core42 leases had all commenced as of March 31, 2026 (60 MW of critical IT capacity energized), and the Fluidstack leases, each with an initial 10-year term, were expected to commence in 2026. TeraWulf's August 2025 announcement of the CB-5 expansion put contracted critical IT load for Fluidstack at about 360 MW (CB-3 and CB-4 delivering more than 200 MW, plus 160 MW in CB-5), representing $6.7 billion in contracted revenue, with Google's total backstop at about $3.2 billion and its pro forma equity ownership at about 14%. Tagged mixed-use since Bitcoin mining (145 MW energized as of March 31, 2026) remains the larger operational segment versus HPC (60 MW of critical IT energized). A New York statewide bill (Responsible Data Center Development Act, S10642/A11560) passed both legislative chambers June 4, 2026, imposing a one-year moratorium on new permits for large (≥20MW) data centers; it remained unsigned/pending before Gov. Hochul as of July 2026. Facilities with construction already underway are exempt, so TeraWulf's current build here is likely grandfathered, but any future unbuilt expansion phase requiring new permits could be affected if the bill is signed before construction starts. As of July 2026, the Niagara County Manager said the project had submitted no application for assistance to the Niagara County Industrial Development Agency.
