Nebius Data Center Disputes: The Vineland, New Jersey Noise Case and the Entity That Was Actually Sued

Large data centers are routinely built and held through entities that do not carry the operating company's name. In Vineland, the residents sued DataOne USA LLC. Nebius Group is the operator identified in the reporting, and the campus is connected in that reporting to a $17 billion agreement to supply Microsoft with AI computing capacity. This is not a technicality. The complaint, filed May 26, 2026 in the U.S. District Court for the District of New Jersey, alleged a constant industrial hum from diesel generators and cooling equipment without adequate sound barriers, at 48 to 60 A weighted decibels, exceeding 50 decibels between 10 p.m. and 7 a.m. in violation of county standards. It pleaded private nuisance, public nuisance, and negligence on behalf of about 1,013 households within one mile, and legal analysis of the case notes the county health department had already issued a violation notice.

These are allegations. No court has ruled on them, and we can document no response from Nebius or DataOne USA to any of them. We looked: as of September 3, 2026 the Nebius newsroom carries financial results, convertible note offerings, executive appointments, sustainability reporting, and a UK infrastructure expansion, and nothing addressing the Vineland noise complaints. Silence is not an admission of anything, and we note it only because our standard is to pair every allegation with the operator's answer where one exists.

The numbers in the complaint moved into the policy debate even though the case did not survive its first month. Governor Mikie Sherrill announced a four part regulatory plan for data center development that includes statewide noise standards, the first such state level standard proposed in response to the 2026 noise cases, and New Jersey has enacted a Data Center Fair Share Act addressing who pays for the power large facilities demand.
