   The NM State Land Office rejected the Aetherion/Green Data sublease proposal at Spaceport America on 2026-09-03, and Land Commissioner Stephanie Garcia Richard ruled Sierra County's 2026-07-21 data-center moratorium applies to Spaceport activity despite it sitting on state trust land. Spaceport's executive director Scott McLaughlin said the facility will honor the decision. The developer (Jason Bak) did not respond to comment and left the door open to a future proposal once moratoria expire, but this specific sublease proposal is dead as of this report. No lease, sublease, construction or development agreement has been executed. On 2026-09-03 NM State Land Commissioner Stephanie Garcia Richard formally rejected the Aetherion sublease and ruled the county moratorium applies to Spaceport America despite it being state trust land, “Simply put, I will not be approving any data centers, including the proposed Aetherion sublease at Spaceport America” (see source 4). That rejection is why this record is now `cancelled`.
