The Village Board of Appeals reversed that denial and approved the permit on 2026-06-08 after the applicant's attorney warned of a writ-of-certiorari action if the board did not decide within minutes ('The judge isn't going to kick it back here and say: come up with conditions... Village of Hammond, you're ordered to issue a conditional use permit.' -- Village Attorney Paul Mahler, recounting the warning). The Village Board then voted 6-0 on 2026-07-07 to direct its attorney to seek a court injunction against its own Board of Appeals, arguing the approval was made under duress. Residents cited noise and water-contamination concerns.
