Opposition and litigation at this site

Nothing on record as of October 1, 2026. No lawsuit, organized opposition, or contested hearing over Middletown Technology Center (Cirrus Delaware LLC) in Middletown, New Castle County, Delaware appears in the sources this registry tracks. That is an absence in our sources rather than a finding that none exists, and local opposition often predates any coverage a national dataset would pick up.

If you live near this site and something is happening that this page does not show, that is worth telling us. Send us the document and it goes in the record with the source attached. For sites where opposition is already established, see every contested site we track.

A new status, a permit, a reception finding, or a lawsuit. Nothing else, ever.

Power and water

Per the applicant at the May 2016 IIC meeting, the facility would 'mostly pull power from the PJM grid from Middletown' over 138 kV lines from an adjacent substation. An on-site natural-gas cogeneration plant would supply redundancy and peak-period power within air-permit hour limits. DBT and Data Center Knowledge (2015) give the gas plant as 52.5 MW. At the 2016 IIC meeting the applicant described the data center as 40 MW, with 36 MW of white space at a design PUE of 1.4, for a 50 MW total requirement at full build.

Notes on the record

Never built, and apparently dormant since the air-permit application was put on hold in October 2017. Status stays 'proposed' because no source records a formal withdrawal or cancellation. Treat the status as stalled, not active. The $7.5M state grant was conditional and reimbursement-only. No evidence was found that it was disbursed, so it is not recorded in subsidies. Sources disagree on cost: $250M (DCK 2015), about $400M (DBT 2015) and $350M (applicant, IIC 2016), so the investment figure is unset. Jobs figures are the applicant's 2016 IIC projections. DBT 2015 cited 'more than 100' full-time and up to 2,000 construction jobs. Partners named at the IIC meeting were Duffield Associates (now Verdantas), MEP Associates and landowner Mautom, LLC. The end operator was never disclosed. The pin is Middletown's OSM boundary centroid, because the 70-acre Westown parcel did not resolve to a point.

What the record does not establish, and the document that would

In every fight on our tracker the decisive fact came out of a public records request. These are the requests for this site.

  • Tax abatements or other public subsidy
  • How the community has received it
  • Which utility serves it
Which document closes each gap

The abatement, PILOT, or development agreement approved by the county, city, or development authority, and the state's data center sales tax exemption certificate if one was issued.
How the community has received it
Planning commission and governing body minutes, public comment records, and any petition or lawsuit filed in the county.
Which utility serves it
The electric service agreement or the utility's filing with the state public utility commission.

Distances are between recorded coordinates, many of which are a city or county centroid, so treat them as approximate. Cumulative load on one utility and one aquifer is the question a planning commission rarely asks.
